1. Scope

These Terms of Use apply to the website byte-performance.com in all language versions. The dealer portal dealer.byte-performance.com and the file service are governed exclusively by the General Terms and Conditions for the File Service and Dealer Portal. The website is directed at businesses (workshops, dealers, tuning companies, manufacturers, fleet operators); it does not constitute an offer to consumers.

2. Content and Catalogue Data

  1. The machine and control unit data in the catalogue (power, displacement, emissions stage, control unit, read method, tool support) are taken from the vehicle lists of the tool manufacturers and from our own experience. They serve as guidance, do not constitute a guarantee and may change with new software or tool versions. The service description in the Portal alone is decisive for an order.
  2. Knowledge articles and news are technical information, not advice in individual cases. Information on emissions systems and their deactivation describes technology and the legal situation; it is not an invitation to operate machines contrary to applicable law.
  3. Stage 1 solutions are offered for listed machines; emissions-related solutions only for approved control units and exclusively for use outside the scope of the respective emissions regulations (motorsport, closed company premises, export, test bench). Details are governed by the File Service Terms and Conditions, § 6.

3. Copyright and Trade Marks

All content of the website (texts, machine data, knowledge articles, images, graphics, software) is protected by copyright. Reproduction, automated extraction (scraping), incorporation into own databases or websites, and publication require our written consent. Printing or saving individual pages for own business use is permitted. Trade marks, product and machine designations of third parties (including manufacturers of machines, engines, control units and tools) are the property of their respective owners and serve identification purposes only; no affiliation with these manufacturers exists.

4. Forms and Contact

Information provided in contact and dealer forms must be correct and complete. A dealer enquiry does not give rise to any entitlement to a Portal account; we decide on activation after verifying business status.

5. Availability and Permitted Use

We endeavour to ensure high availability of the website but do not owe uninterrupted accessibility. Attacks on the website, circumvention of access restrictions, load testing and the introduction of malicious code are prohibited.

6. Links

We provide links to third-party websites after careful review; the respective operators are responsible for their content and data protection. No consent is required for links to our website, provided they are not placed in a misleading context.

7. Liability

We are liable for the content of the website only in cases of intent and gross negligence. Decisions that users make on the basis of the catalogue data or knowledge articles (in particular writing software to control units) are made at their own risk and must be verified by qualified personnel. Liability for personal injury and under the Product Liability Act remains unaffected.

9. Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. The place of jurisdiction for businesses is Graz, Austria. Should any provision be invalid, the remainder remains in force. We may amend these Terms of Use with effect for the future; the version published on the website with its date applies.
